Samuel Alito 101

People for the American Way – one of the core Jesus freak watchdog organizations – has put together a great summary of what to expect from Alito.

Hostile to basic reproductive privacy rights: Alito wants government to be able to interfere in personal decisions on reproductive rights. In Casey, Alito stated that he would have upheld a provision of Pennsylvania’s restrictive anti-abortion law requiring a woman in certain circumstances to notify her husband before obtaining an abortion. His colleagues on the Third Circuit and the Supreme Court majority disagreed and overturned the provision.
Rejects basic protections for workers: In a number of dissenting opinions, Alito has taken positions that, if adopted, would have made it more difficult for victims of race and sex discrimination to prove their claims. In one case involving claims of race discrimination, the court majority sharply criticized Alito’s dissent, stating that Alito’s “position would immunize an employer from the reach of Title VII” in certain circumstances.
Leads revolution against federal laws protecting individual and other rights: According to one of Alito’s opinions, Congress had no authority to require state employers to comply with the Family and Medical Leave Act, a ruling that was repudiated by the Supreme Court in a later case in which conservative Chief Justice Rehnquist, no friend of civil rights, wrote the Court’s decision. Alito also dissented from a ruling by the Third Circuit that Congress has the power under the Commerce Clause to restrict the transfer and possession of machine guns at gun shows.
Fails to consider racial discrimination in capital punishment: An African American had been convicted of felony murder by an all white jury from which black jurors had been impermissibly struck because of their race. Alito cast the deciding vote and wrote the majority opinion in a 2-1 ruling rejecting the defendant’s claims. The full Third Circuit, in a split decision, reversed Alito’s ruling, and the majority specifically criticized him for having compared statistical evidence about the prosecution’s exclusion of blacks from juries in capital cases to an explanation of why a disproportionate number of recent U.S. Presidents have been left-handed. According to the majority, “[t]o suggest any comparability to the striking of jurors based on their race is to minimize the history of discrimination against prospective black jurors and black defendants . . .”

  1. That’s pretty fucking scary. And I bet he gets confirmed. Unless his confirmation is strictly down party lines (where ALL Democrats vote against him), it will only confirm what I already believe: that both parties are completely full of shit.
    I hope I am wrong.
    Oh and as far as the Dobson thing goes: Welcome to America! This country is TRULY a Theater of the Absurd!

  3. Jane: Yes. It is truly frightening at times. I agree with you about people who stop learning. Sometimes I wonder if they ever learned anything at all. If it’s not the schools in the South that are demanding to stop teaching evolution, it’s the so-called “liberal” colleges that merely pass on propoganda and indoctrinate students rather than educating them. (Then again, people do have minds. It’s that they choose not to use them). Part of the problem is, I think, is that everything is divorced from the context of history. Some people think that everything that happened before they were aware of it doesn’t exist. Others just want to be seen as “liberal” (and “conservative”) and merely spit out the party line. To them, it makes them appear “enlightened” and “sophisticated” but it really makes them look close minded and ignorant.
    In a society that comes up with more conspiracy theories than ever; a country that still believes that Adam & Eve is literally true and that evolution is ‘evil’; a country where the exploits of celebrities and knowledge of trivial pop culture matters passes off as being knowledgeable, it’s no wonder why we are in the state we are in.
    But I want to see what happens with this Alito guy. I fear he may be confirmed, despite all the ranting and raving. I may be wrong (I hope) but I don’t have any faith at all in either party to do what’s right for the American people. But as I always say, these so-called leaders are put there by the American people (or those who bother to vote, anyway) so you know where the responsibility ultimately lies.
    But…I think if the American people were more aware of things other than Angelina Jolie’s babies or Tom Cruise’s exploits or Paris Hilton’s sex romps, things would be different. Maybe.
    At any rate, the prospects for the future do not look good to my eyes. Sad.

  4. Hi Sergio…You sound like me. I truly think that there is too much information out there for people on the internet, radio, TV, etc…that they really have no idea what to believe any longer. They can be persuaded so easily by different groups that preach distortion as the truth such as the RR and truly, I feel it is because of the RR we are in the most danger. I cannot get over how many people believe what people like Dobson, Falwell, and Robertson (just to name a few) are able to lie to millions of people about our history, (which is not very old), and these people believe every word they say. It is sad, Sergio…it is sad that people do not go to the library or bookstore and READ…educate themselves instead of relying on people with nothing but a corrupted agenda to teach them.
    We are so lucky here in the States to be granted Intellectual Freedom. Why people do not take advantage of this wonderful right our forefathers gave to us is beyond me. And what is worse is that so many millions are willing to give their Intellectual Freedom up for tyranny…for what our forefathers had run away from in the first place!!!!!!!!
    Oh, Sergio…I’m not so sure if the American Leaders are put in their positions by the American people any longer. I don’t trust the electoral college any longer. I also think we really don’t have much to choose from any longer…do we? Bush or Kerry…Bush or Gore. And although I am an American person, I will not be blamed for putting the present leader of our nation where he is today! 😉
    And I am with you on Alito…if he gets in, we are doomed. I used to be optimistic…but since I’ve been Bushwhacked, I just don’t have it in me any longer. Sad. Yes, very sad.
